Terms of Service
1. Acceptance
These Terms govern your use of forj.se and the Alloy platform ("the Service"), provided by Forj AB (org.nr 559019-9161, currently registered as Zmart Com West AB) ("Forj", "we"). By using the Service you agree to these Terms.
2. The Service
Alloy is a multicloud sales platform for hyperscaler partners, with an AI co-worker ("Smith") that helps partners across AWS, Azure and Google Cloud identify, research and progress co-sell opportunities. Smith advises and drafts; it does not act on your behalf. You review and decide before anything is sent or changed.
3. Accounts
You are responsible for your account credentials and for activity under your account. You must provide accurate information and keep it current.
4. Acceptable use
You agree not to misuse the Service: no unlawful processing of personal data, no infringement of others' rights, no attempts to breach security or exceed authorised access, and no use that violates applicable law or third-party platform terms (including the relevant cloud partner-program terms and any connected tools such as HubSpot or OnePageCRM).
5. Your data & privacy
Our handling of personal data is described in the Privacy Policy. Where we process personal data on your behalf, our Data Processing Agreement applies. You are responsible for having a lawful basis for the data you load into or connect to the Service.
6. AI output
Smith's outputs (drafts, research, estimates) are generated with AI and may contain errors. They are suggestions for your judgement, not professional, legal, or financial advice. Verify before you rely on or send anything. Cost and funding figures are estimates to be validated.
7. Intellectual property
Forj retains all rights in the Service, Alloy and Smith. You retain rights in your own data. You may not copy, resell, or reverse-engineer the Service except as permitted by law.
8. Fees
Commercial terms (including any cloud partner-funding arrangements such as AWS MAP or the Microsoft and Google equivalents, or subscription fees) are set out in your order or engagement agreement.
9. Disclaimers & liability
The Service is provided "as is" without warranties to the extent permitted by law. To the maximum extent permitted by law, Forj's liability is limited as set out in your agreement. Nothing limits liability that cannot be limited by law.
10. Term & termination
Either party may terminate as set out in the applicable agreement. On termination, we will delete or return your data per the DPA.
11. Governing law
These Terms are governed by the laws of Sweden, with disputes subject to the competent Swedish courts, unless your agreement states otherwise.
